You must agree to the following statement of responsibility (the “Agreement”) in order to participate in any of the Jerusalem University College (“JUC”) programs, trips, and experiences (jointly referred to herein as the “Travel Program”), and to participate in any of the JUC online programs or classes (referred to as the “Online Program;” together, the Travel Program and Online Program are referred to as the “Programs”).
Standards of Conduct
Throughout my participation in the Programs I will comply with JUC’s manuals, rules, standards, and instructions for student behavior. I waive and release all claims against JUC that may arise at a time when I am not under direct supervision of JUC or that are caused by my failure to remain under such supervision or to comply with such rules, standards, and instructions.
I understand that the countries where JUC operates, as well as Jewish and Arab cultures, have their own laws and standards of acceptable conduct, including dress, manners, morals, politics, drug and alcohol use, and behavior. I recognize that behavior which violates those laws or standards could harm JUC’s relations within the Middle East, as well as my own health and safety. I will become informed of, and will abide by, all such laws and standards in the Holy Land during the Travel Program, as applicable.
I agree that JUC has the right to enforce the standards of conduct described above, in its sole judgment, and that it will impose sanctions, up to and including expulsion from the Programs, for violation of these standards or for any behavior detrimental to or incompatible with the interest, harmony, and welfare of JUC, the Programs, and other participants. I recognize that due to the circumstances of foreign study programs, procedures for notice, hearing, and appeal applicable to student disciplinary proceedings at JUC do not apply. If I am expelled for any reason, I consent to being sent home at my own expense with no refund of fees.
I will attend to any legal problems I encounter with any foreign nationals or government of the host country as a result of my participation in the Travel Program. JUC is not responsible for providing any assistance (legal or otherwise) under such circumstances, and under no circumstances shall JUC indemnify me for legal expenses arising out of legal problems with foreign nationals or governments.
Assumption of Risk, Release, and Waiver (applicable to Travel Program only)
Assumption of Risk. I acknowledge that my participation in the Travel Program (as applicable) may expose me to a risk of loss, delays, personal injuries, property damage, or even death. I understand that these potential risks include but are not limited to: travel to and from Israel; losses, delays, or additional expenses resulting from insufficient or improper travel documents beyond JUC’s control; local transportation to and from JUC’s site in Jerusalem; political, legal, social, and economic conditions; language barriers; safety hazards; crime; disease; consumption of food; civil unrest or hostilities; terrorism; war; natural disasters; weather conditions; negligent first aid operations or medical treatment; and other risks that are unknown at this time. JUC does not assume responsibility for any such personal injuries or property damage. Knowing the dangers, hazards, and risks involved, and in consideration of being permitted to participate in the Travel Program, and for JUC arranging said participation, I agree to assume any and all risks and responsibilities surrounding my participation in the Travel Program, the transportation, and in any independent research or activities undertaken as an adjunct thereto.
Release and Waiver. I, on behalf of myself and my family, heirs, and personal representatives, hereby release, indemnify, and hold harmless JUC, and its past and present trustees, officers, employees, agents, and the heirs, successors, and assigns of each from and against any present or future claim, loss, liability, or expense (including attorneys’ fees) resulting in or arising from my participation in the Travel Program (including periods in transit to or from Israel).
Health and Safety (applicable to Travel Program only)
I acknowledge being advised of the rigorous physical and emotional demands of the Travel Program, including, but not limited to, strenuous walking and hiking up to 10 miles per day over uneven, rocky, and uphill terrain. If required by JUC due to age or health constraints, I will consult with a medical doctor with regard to my personal medical condition and needs. There are no health-related reasons or problems which preclude or restrict my participation in this Travel Program.
I am aware of all the applicable personal medical needs. I have arranged, through insurance or otherwise, to meet any and all needs for payment of medical costs while I participate in the Travel Program. I recognize that JUC is not obligated to attend to any of my medical or medication needs, and I assume all risk and responsibility therefore. If I require medical treatment or hospital care in a foreign country or in my home country during the Travel Program, JUC is not responsible for the cost or quality of such treatment or care. I will ensure that my insurance provider will cover my health, accident, travel, and life insurance while in Israel and in transit thereto or therefrom.
JUC is not obligated to, but may take, any actions it considers warranted under the circumstances regarding my health and safety. I agree to pay all expenses relating thereto and release JUC from any liability for such actions.
Illness and Absence
I acknowledge that I am responsible for any expenses accrued upon a late arrival or early return during the Travel Program. For the Programs (including the Online Programs), I understand that there will be no refund for absence or early departure , including, but not limited to, missed accommodations, transportation, meals, and optional extensions, as applicable.
Program Changes
JUC has the right to make cancellations, substitutions, or changes in case of emergency or changed conditions or in the interest of the Programs. I understand that conditions may force a change in itinerary, instructors, accommodations, schedules, and programs. If I leave or am expelled from the Programs for any reason, there will be no refund of fees already paid. I will hold JUC blameless in the event of cancellation or changes to Program schedules. For the Travel Program specifically, I will hold JUC blameless in the event of cancellation or changes in travel, or adjustment in announced fees caused by changes in air tariffs, lodging rates, or fares by those engaged for such services. I accept all responsibility for loss or additional expenses due to delays or other changes in the means of transportation, other services, sickness, weather, strikes, or other unforeseen causes.
I understand that JUC is not responsible for additional travel arrangements that I have made myself or through a third party which may be affected by JUC cancellations.
Promotional Rights
As a condition of my participation in the Programs, I hereby grant JUC the right to use, for promotional purposes only, any photographs or videos of me taken by JUC, its employees, or agents, during my participation in the Programs. I further understand and agree that JUC may use, for marketing purposes, any statements or quotes attributed to me in my evaluation of the Programs.
Governing Law/Forum/Severability
I agree that this Agreement shall be construed in accordance with the laws of the state of Ohio, which shall be the forum for any lawsuits filed under or incident to this Agreement or the Programs. The terms and provisions of this Agreement shall be severable, such that if a court of competent jurisdiction holds any term to be illegal, unenforceable, or in conflict with any law governing this Agreement, the validity of the remaining portions shall not be affected.
Acknowledgement and Signature
I acknowledge and represent in signing this application and Agreement that I have become fully informed of the content of the foregoing by reading it before signing it. By typing my name in place of my signature below this Agreement, and/or by submitting this application as my own free act and deed, I (1) confirm that no oral representations, statements, or inducements, apart from the foregoing Agreement, have been made, and (2) acknowledge and agree to the foregoing. By typing my name as my signature or submitting this application, I certify that the information on this application is complete and correct, and I understand that the submission of false information is grounds for denial of my application, withdrawal of any offer of acceptance, cancellation of enrollment, or any appropriate disciplinary action including expulsion. I authorize JUC to verify the information I have provided in this application.
